Customer Discovers Server Tipped Herself On Togo Order And Complains, Server Loses Her Job

Ordering food from your favorite restaurant should be a straightforward experience, but for one customer, an extra $10 charge on a routine order led to a surprising outcome. After noticing an unexpected tip added to their Togo order, they decided to speak with the manager to resolve the issue.

What seemed like a simple mistake turned into a bigger conversation, but when the customer left with a refund, they didn’t expect it to cost the server her job.

Now, the customer is wondering: Was it wrong to complain about the extra tip, or should they have just let the mistake slide? Keep reading to see how this situation played out and whether they were justified in their actions.

'Server tipped herself 10$ on my Togo order and I complained. She lost her job?'

I go to this restaurant quite often, locally, for just a pulled pork sandwich.

Every single time I order the same thing, Togo, it’s 17.55.

With taxes & fees and all the new ridiculous charges they put on.

I know this because I checked my banking statement.

I recently ordered this sandwich this past week over the phone and noticed I was charged $29.20.

The same thing I order twice a month, I made a mental note.

I went in for pick up and immediately asked for a receipt.

I was told that there was something wrong with the machine, so I asked to speak to the manager about my sandwich pricing.

The waitress who took my order told me to avoid any further confrontation,

she would void it out of the system because the manager wasn’t there and wouldn’t be till 4.

I said okay and left, mind you, in my head I got a free sandwich and I’m coming to talk to the manager at 4 because that was kinda shady.

I finally get to speak with the manager who was able to confirm the receipt we’re working fine

& she was able to pull up my order from that day and see there was an excess tip left for the waitress and that was the extra charge.

I didn’t make a big deal out of it, I was refunded.

I was genuinely curious about the sandwich pricing and if they were charging a larger Take out percentage-which was currently 10%.

I went in today and found out she was fired right after.

Should I had just taken my free sandwich and let it go? Edit: She was clearly pregnant and couldn’t be no more then 25

In this situation, the Original Poster (OP) is grappling with whether they were right to report a server who allegedly tipped herself $10 on an order.

While OP was initially concerned about being overcharged for their sandwich, they later discovered that the extra charge was actually a tip that the server had added without OP’s consent.

When OP reported this to the manager, the server was fired. The question is whether OP’s actions were justified, or if they should have just accepted the free sandwich and moved on.

From an ethical standpoint, OP’s actions were completely justified. Tipping is an expected part of restaurant service, but it should always be voluntary and based on the customer’s discretion. Taking a tip without consent crosses a clear boundary.

According to restaurant industry expert Dr. Leonard Seltzer, “Tipping is a contractual agreement between the customer and the server. If a server adds a tip without the customer’s agreement, it’s a form of theft and could lead to serious consequences, as it undermines trust and damages the integrity of the business”.

OP had the right to question the overcharge and report it, especially if they were unaware that a tip had been added to the order.

However, the consequences of the server’s actions are more complicated. While the server’s behavior was wrong, the manager’s decision to fire her raises some important considerations.

As human resources expert Dr. Carla Naumburg notes, “Firing an employee over one mistake, especially if the employee is pregnant and young, could be seen as a disproportionate response. It may have been a teaching moment instead of a dismissal, especially if the employee was otherwise good at her job.”

The severity of the action may depend on the company’s policy, but in general, terminating an employee over a single instance of misconduct can be seen as harsh if there’s no prior history of similar behavior.

In hindsight, OP could have handled the situation differently by addressing it with the server directly or giving the benefit of the doubt, especially given her apparent personal circumstances. Nevertheless, OP had the right to question the charge and ensure that they were not being overcharged or defrauded.

I don’t receive tips anymore (they’re pooled and only for shift leads and regular employees; I have to earn a quarterly bonus)

but if I had an employee steal from our customers, I’d let them go too.

It’s an unfortunate lesson to learn but hard times don’t mean you pass it on to others to carry for your. If this is your lot, it’s yours.

I know life is hard because I worked my way up very slowly.

I lived in an old FEMA trailer leftover from Katrina in a trailer park and worked three jobs for college.

It was hell and I don’t think anyone else should ever have to do that, so I didn’t make my misery other people's problem.

And now that I have more, a good chunk of it goes towards supporting others because I finally can.

I find enormous joy in giving to others what I didn’t have.

Having been single, disabled, pregnant and alone myself, I can’t imagine stealing from people. I got public assistance. I went to food banks.

I joined a generous church and stayed involved supporting others like me. I lived cheaply.

Almost entirely on bagged beans and rice or whatever my restaurant would let me take home.

It took a thousand little things to get me through it. But there’s a way to do it without stealing. She had alternatives. She chose wrong.

Maybe she’s in her situation because she makes decisions like these. Let her have the space and struggle to learn.

AkamiMaguro − NTA. First she stole from you, then she stole a sandwich from the company to "make it right" with you.

ZoeticLock − NTA. Her being pregnant isn’t a free pass to steal.

It probably was more than just you and your talk with the manager probably made them investigate other orders she had been taking.

I would be you aren’t the only one she pulled this stunt on.

It might seem trivial for the server to lose a job over just a few dollars

but if they got away with it and kept doing it there could be a lot of people out of pocket for a few dollars. NTAH. Justice was served.

morphinecolin − I worked in a check cashing place and there was a guy I would work with who, once in a while, maybe twice a week,

would have someone turn around and go ‘you were supposed to give me 623$

and you gave me $622’ and he would be like ‘oh, I’m sorry’ and give them the dollar or two, whatever was due. Always $1-3 dollars.

Sometimes an 8 was a 6, or a 5 was a 3, or an 8 was a 5.

But reliably, once or twice a week in my presence, someone would call him out on it.

He would later be fired because he got caught on camera pocketing cash and he still balanced out, which is when it made sense.

He had a system to short each and every customer he had, if he got called out it was an accident;

if he didn’t, he would pocket the remainder.

I spent a few days making notes after he left and guessed that if he was legitimately doing it to everyone,

he was probably pocketing $150-$200/day in 2003. 39-52k/yr of untracked and untaxed revenue.

Just by not being too greedy. I fear like twenty people are going to get an idea now,

but 2003 was a much more cash based society than now,

it’d probably be pretty hard to do this anywhere but at a check cashing place/ payday loans place.
