Pregnant Employee Finds HR Tried to Deny Her Maternity Pay, Then Discovers the Evidence They Left Behind

Pregnancy is already a time filled with enough changes and uncertainty, so dealing with workplace problems on top of that can feel incredibly overwhelming.

Most employees expect their company to support them during such an important stage of life, not create more stress right before maternity leave begins.

The original poster (OP) was preparing to leave work for maternity leave when HR suddenly claimed she was not eligible for statutory maternity pay.

However, something about their explanation did not add up, and OP decided to investigate instead of accepting their answer.

What she discovered left her questioning whether it was a simple mistake or something much more concerning. Scroll down to see what happened next.

'HR tried to get out of paying me maternity leave using a fake reason- then my employer asked me to bring the evidence back!?'

Okay y’all, grab your popcorn 🍿 because I’ve got a story that I’m pretty sure

Charlotte Dobre would read with a raised brow and full sass mode activated.

So I’m currently 32 weeks pregnant in the UK and work for a company that,

until recently, I thought was fairly normal. But HR? Turns out they’ve been

playing games — and not the fun kind.

I'm two weeks away from starting my maternity leave, and I received a

WhatsApp from the girl who is in charge of HR at the company I work saying I

wasn’t eligible for SMP (Statutory Maternity Pay, which is provided by the

government to my employer) and that my documents are waiting in the office

for me to pick them up. I knew I was eligible and I meet the criteria (I've

worked for more than 26 weeks and earn over the weekly threshold). When I

told her instead of explaining anything, she ghosted me, deleted the message

where she said I wasn’t entitled, and stopped replying entirely. 🚩🚩🚩

So I did what any suspicious but determined mama would do — I called HMRC.

And guess what? They confirmed: I AM ELIGIBLE. 100%. They even told me

that I should open a legal dispute.

WELL. I remembered that she mentioned some documents that "belonged to

me", so I ended up sneaking into the office before anyone else got there and

found mentioned documents: the SMP1 form that HR filled out of why my

employer cannot pay me for maternity leave, stating the reason why. And y’all

— this is where it gets juicy.

Instead of ticking one of the official boxes (the legal reasons why an employer

can refuse), HR had handwritten (with actual pen) that I’m not entitled to SMP

because I’m on a zero hours contract.

Um… EXCUSE ME??? That’s not a legal reason to deny SMP. Like at all. Zero-

hours contracts don’t disqualify you if you meet the time and pay

requirements (which I do — again, confirmed by HMRC).

So I message my employer directly, and he’s all, “Oh, I’ll look into it and keep

you updated”. A whole day later he messages me back,and says the forms I

have are “wrong” and asks me to bring them back. 😳

Sir. You want me to return the only physical proof I have that your company is

making up reasons to deny me maternity pay and doing illegal things? LOOOL.

Absolutely not. I’m keeping this one — scanned, photographed, and safely

filed.. At this point:. * HMRC confirmed I’m entitled.. * My employer made up a

fake reason to deny it.. * HR ghosted me.. * And now they’re trying to erase the evidence?

I’m documenting EVERYTHING. Because something tells me this isn’t just

incompetence — it’s starting to feel intentional, like why would they deny to

pay for something that isn’t even coming from their pockets? It’s governments money!

I’m trying to be patient and nice waiting for my employers response,

considering I still have a couple of weeks at work, and escalating this issue

would create a really tense environment at work that I wouldn’t wish to be

involved. I don’t need any more stress and anxiety for me or my baby.

However if he doesn’t fix it within 5 working days, I’m afraid I’ll have to

escalate the issue to HMRC’s Disputes team and ACAS.

There is a particular kind of stress that comes from being vulnerable and realizing the people responsible for supporting you may not have your best interests in mind.

During pregnancy, many employees expect their workplace to provide stability and reassurance. I

nstead, OP found herself having to investigate whether her own employer was withholding something she believed she legally qualified for.

The emotional weight of this story goes beyond maternity pay. OP was not simply frustrated about paperwork.

She was approaching a major life change, preparing for her baby, and suddenly faced uncertainty created by the very organization that should have provided clarity.

The deleted messages, lack of communication, and conflicting explanations made the situation feel less like a simple administrative mistake and more like a breach of trust.

What makes this situation especially interesting is that many people assume workplace disputes are only about money.

However, workplace conflicts often become emotional because they affect a person’s sense of security and fairness.

For someone preparing for maternity leave, being told “you are not entitled” without proper explanation can feel like being told that their needs do not matter.

At the same time, OP’s response shows a different side of workplace conflict: the importance of calmly gathering information before reacting.

Rather than immediately confronting the company emotionally, she checked official guidance, contacted HMRC, collected documentation, and created a record of events.

This approach reflects a shift many employees experience when they realize they need to advocate for themselves professionally.

Employment experts often emphasize that workers should understand their rights and keep written records when disagreements arise.

This advice connects directly to OP’s situation. The issue was not only whether the company made a mistake, but whether they could explain their decision and correct it transparently.

Written documentation protects both employees and employers because it reduces confusion and ensures decisions are based on facts rather than assumptions.

Pregnancy and maternity rights exist because workers should not have to choose between protecting their income and protecting their health during such an important period.

Even if the company eventually fixes the situation, the experience may still leave OP questioning why she had to fight so hard for something she was already entitled to receive.

The larger lesson is that knowing your rights does not make someone difficult or confrontational.

Sometimes self-advocacy simply means asking questions, keeping evidence, and refusing to accept an explanation that does not match the facts.

A workplace relationship can only remain healthy when trust goes both ways.

be investigating - it's VERY sketchy. Absolutely keep your evidence. And check

everything else about your pay/conditions, just in case.

ChangeOfHeart69 − Girl, don’t wait, do what HMRC said and file a legal

dispute! !! They were probably gonna try some shady s__t to take that money for themselves! !!

This group advised OP to create a strong paper trail by saving messages, sending documents formally, and documenting every interaction

irish_ninja_wte − Send your employer the scan of it, through email. That way

they cannot delete it. It's also very suss that your HR is contacting you through

WhatsApp, instead of through a more formal means of communication. While

I'm not in the UK, I would imagine and it's similar to Ireland.

Here, it's definitely the time that you have worked and not the contracted

hours that you have. You're right to not hand over the original documents, but do email that scan.

Ok_Friend9574 − Mate you should be escalating this anyway. This is so

sketchy! Maybe once you're out of the office? So you don't have to see them

everyday, they have to hold your job, because that will be the next thing that

they'll find a reason to fire you when you get back. Start the paper trail now. And congrats

Aggressive-Walrus516 − Honestly, at this point you should probably escalate it.

If you are 2 weeks from maternity leave they are playing big games, plus when

you get back they may retaliate so make sure you are documenting EVERYTHING.

Every interaction, screen shot messages immediately before they can be

deleted, notate conversations “on 19-6-25, at 9am - BCI Technologies HR

manager - David Peters asked to speak with me in his office. He stated that

Tara HR generalist made an error etc. ” And if you can maybe research your

employee handbook. I would be prepared for anything.

Keep your head up, don’t let this cloud such a joyful occasion for you, and

congratulations! ! You can use a Notes app on your phone, go to the bathroom to type out what transpired.

I don’t think they will stop, they are going to try to pull “so and so from HR

filled out your form incorrect, she will under go retraining to make sure this

doesn’t happen in the future” I wonder how many others they did this to. Just keep covering your b__t.

They don’t get to decide who’s not entitled, I’d play dumb too, if they want to

play with fire they’ll get burned but it’s due to their own incompetence.

are not capped (meaning the jury can send a very strong message to your

employer) this could be a very, very expensive mistake :)

Summertime-Living − They are definitely trying to cheat you out of your money. Lawyer up!

These users argued OP should not wait for explanations and should take action quickly because the employer’s behavior appeared intentional or dishonest

in case they do this again to you or someone else. This shows a pattern of behavior.

OP thought she was dealing with a normal maternity leave process, but instead she found herself having to investigate her own employer just weeks before giving birth.

What makes this situation worse is that the issue wasn’t a simple mistake, the paperwork appeared to include a reason that didn’t match the legal requirements, and then the company suddenly wanted the documents back.

Now OP is stuck balancing protecting herself, her baby, and her evidence while waiting to see if her employer fixes the situation.
