She Takes A Stand After Her Neighbor’s Son Sneaks Into Her Pool, But Now She’s Facing The Backlash

in Social Issues

In a close-knit neighborhood, it’s easy to feel pressure to accommodate everyone, but sometimes setting limits is necessary, especially when it comes to safety.

That’s what one woman realized after her neighbors kept sending their 7-year-old son to play at her house and swim in her pool without asking.

When the boy snuck into her pool area, she took action and told the parents that he would no longer be allowed in the pool without supervision.

Her concern for safety and liability led to a confrontation, with the parents accusing her of being heartless.

Not the actual photo

'AITJ for telling my neighbor her kid isn't allowed in my pool after she "forgot" him at my house?'

I'm (37F) honestly still shaking a bit while writing this because i hate confrontation, but I feel like I'm being treated like a villain in my own neighborhood.

My husband and I bought our house about 2years ago. One of the main reasons we chose it was the backyard and the pool.

We have two kids (a son and a daughter), and they practically live in that water during the summer.

A few months ago, a new couple moved in next door with their 7-year-old boy.

At first, things were fine. We did the whole "welcome to the neighborhood" thing, and our kids played together a few times.

The problem started about 3weeks ago. The parents started sending their son over to play, but neither of them would come with him.

They’d just watch him walk across the lawn from their porch and then go back inside.

Basically, I became an unpaid lifeguard and babysitter for a kid who is not mine.

The breaking point happened last Saturday. I told the mom earlier that morning that we were busy and could not have company.

Around 2 pm, I looked out my kitchen window and saw her son inside my gated pool area. He had climbed over the fence.

I ran out there and got him out safely, then walked him back home. Both parents were in their garage, hanging out.

When I told them what happened, they did not even look scared. The dad just laughed and said, Oh, he’s such a little fish!

He just loves your pool so much; we did not have the heart to tell him no. Then the mom chimed in with, It takes a village, right?

I told them right then that he is not allowed in my pool area without me being there, and one of them being there to watch him, too.

I told them it's a huge safety risk and I'm not comfortable with the liability.

They both got really offended and called me heartless.

They said that since I'm already out there with my kids, it should not matter if one more joins in.

The mom even posted on our local Facebook group (without naming me, but everyone knows) about wealthy neighbors who think they own the water and how some people have no...

Now, they are not speaking to me, and some of the other neighbors are giving me weird looks.

I feel like I'm just trying to keep a kid from drowning and protect myself from a lawsuit, but people are making me feel like I'm being a mean girl...

Am I the jerk here?

TL;DR: My married neighbors keep letting their 7-year-old son sneak into my pool without asking.

When I told them he’s banned for safety and liability reasons, they called me heartless and complained to the neighborhood.

OP’s situation reflects a crucial issue of responsibility, safety, and personal boundaries in shared living spaces.

The core of the conflict centers around OP’s desire to ensure the safety of her property, specifically her pool, while also asserting her boundaries with her neighbors.

The neighbor’s 7-year-old child has repeatedly entered OP’s pool area unsupervised, which has raised significant safety and liability concerns for OP.

First and foremost, it’s important to note that pool owners have a legal and ethical responsibility to ensure their pool is safe for everyone, especially young children.

Under the attractive nuisance doctrine, property owners can be held liable if a child trespasses onto their property and is injured, especially if the child is attracted by something hazardous, like a pool.

According to Victims Lawyer, pool owners are required to take reasonable steps to prevent children from accessing the pool area unsupervised, including installing barriers and gates.

OP’s concern about liability is not unwarranted. If something were to happen to the neighbor’s child in her pool, OP could potentially face legal consequences, even if the child entered the area without permission.

Furthermore, OP’s desire to maintain control over who enters her pool area is reasonable and responsible. Lepley Law explains that pool owners must make efforts to prevent unauthorized access and mitigate potential risks.

These steps are not only about protecting the property but also about ensuring that other families are not inadvertently exposed to risks that could cause harm.

The neighbor’s child, without supervision, could easily slip or drown, and OP has every right to enforce boundaries around her pool for the safety of everyone involved.

The tension here arises from the neighbors’ response. By dismissing OP’s concerns with comments like “it takes a village,” the parents are downplaying the importance of personal boundaries and safety.

Psychology Today discusses how these kinds of oversimplified views can contribute to misunderstandings, especially when it comes to personal responsibility and the safety of others.

The suggestion that OP should simply allow the child to join in because “she’s already out there with her kids” reflects a lack of respect for OP’s ownership and concerns.

While OP may be seen as harsh for refusing to let the child into the pool, her actions are entirely justified. OP is trying to avoid a potential tragedy and protect herself from the risk of liability.

It’s important to remember that protecting one’s property and maintaining safety boundaries is a reasonable course of action, especially when it involves the safety of children.

OP could have communicated her boundaries in a more collaborative way, but her decision to restrict access to the pool area is ultimately about preventing harm.

Moving forward, OP could consider a more open conversation with the neighbors, reiterating her concerns in a calm and clear manner.

She could even suggest alternative, supervised visits to the pool to ensure everyone’s safety. That way, the neighbor’s child could still enjoy the pool without jeopardizing OP’s peace of mind or safety.

Ultimately, OP is taking a responsible and thoughtful approach to managing her property.

She is well within her rights to ensure that her pool area is only accessed under appropriate circumstances, and her actions reflect a desire to prioritize safety and protect herself from potential legal repercussions.

Here’s the input from the Reddit crowd:

These users were highly supportive of the OP’s decision to enforce privacy and safety regarding the pool.

Any_Vehicle7847 − "It takes a village" only works when the village actually agrees to help.

You did not sign up to be a free lifeguard. The fact that they laughed after he climbed a fence is terrifying.

They should be thanking u for saving their son, not trashing you on Facebook. NTJ!

Cold_Ball_7670 − YTA for posting this fake bs.

Any_Strawberry8691 − Not the jerk! He climbed over a fence? That's not playing, that's trespassing and a massive safety risk.

Don't let them guilt-trip you. Your pool, your rules, your liability.

These commenters criticized the neighbors for their lack of responsibility and common sense, noting that it was reckless for the child to climb the fence and enter the pool unsupervised.

Katja1236 − NTA. You think you own your own pool? How entitled of you. *eyeroll* It's a safety matter.

Kids that young shouldn't be swimming without a parent present, or another adult who has agreed to supervise in advance. You have not.

LoopyMercutio − NTJ. Since the neighbor decided to make it public, make the entire issue public.

State that they were sending their kid over without any adult supervision at all, that the parents were sitting in their garage not watching their child, that they expect you...

And on top of that, their continued trespassing is now forcing you to add locks and probably have to re-fence your pool for safety and insurance reasons (and of course,...

Glass-Cat8159 − Comment on the fb post “you let your 7-year-old walk over to my house alone, climb over the fence, and get in a pool. Alone.

I’m just trying to make sure your kid doesn’t drown since it seems you do not care about his safety. ” If they wanna shame you, shame them right back....

guitargeek76 − If the pool is in YOUR backyard, then yes, you own the water. NTJ, your neighbors are entitled to AH's.

duskalyth − Their kid climbed in your fence into a pool, and they just laughed?? That’s not “village”, that’s bad parenting

EnvironmentalLuck515 − I think you are imagining the neighbors giving you weird looks.

No responsible adult would have a problem with this, and most would be incensed on your behalf.

This isn't a decision you need to second-guess in any way. If the child drowns on your property, you will be held liable.

I'd be sending them a certified letter outlining what happened, what you did, and how you responded.

Because if he really did climb the fence, this IS going to happen again, and you want documentation that you addressed it with the parents immediately.

[Reddit User] − But you do own the water, no?

These Redditors shared personal stories about dealing with similar situations, such as having children or neighborhood kids attempting to use their pool without supervision.

treedolla − Had a new neighbor woman who came by with her young children a few days after moving in, to "introduce themselves."

First meeting, and she is right away hinting about our pool and how hot it is, obviously fishing for an invitation for her kids to use it. Nope. Not at...

So there was some small talk and a lot of long silences, but the word pool had zero chance to ever leave my mouth.

If our kids became friends and my kids wanted to invite their friends over, certainly. That would be different.

That would be unlikely, seeing as I have no kids and I don't want to live a kid-friendly life nor be a lifeguard and babysitter for the sake of my...

I'm not even trying to be friends with my neighbors, because of things like this post and a host of other issues you might see on reality TV.

Poundaflesh − My sister had a backyard above-ground pool, and a kid climbed the fence and drowned in it.

She was at work, her kids were at school, I don’t remember who found the body, but it was on the news, and it was a long legal hassle.

I don’t know all of the details because she was so traumatized by the child’s death that I didn’t want to make it worse by being nosy.

She shut down and only talked to my mom about it. It really messed her up.

These neighbors are lazy and horrible parents! Never would I let my kids swim without supervision! You’re not their babysitter!

You’re absolutely brilliant for setting boundaries! They’re just mad because now they have to watch their child. The gall!

1954smerickson − I had the only pool in my old neighborhood, daughter was in 3rd grade.

The first warm day, 5 neighborhood kids stood on my front porch, in swimsuits & pool toys, asking if my daughter could “come out & play”.

First day, ok, but I called my attorney friend to ask what my liabilities would be, as I refused to spend my summer weekends babysitting others’ children.

She wrote me a short notice for parents to sign, that included 1) no children on the property unless parents were there to watch said children & 2) waive all...

Paperwork had to be signed, or no swimming at my place. Not one parent returned the said document & children quit asking.

I also added a million-dollar umbrella policy, just in case kids broke into my backyard.

This was back in the mid-90’s, so no cameras, etc. (haha, AOL dial-up was premier!)

These commenters were more blunt, calling out the neighbors’ bad parenting and sense of entitlement.

laurenzobeans − “There are many things wrong with your statement.

1.) I wasn’t “outside anyway.” I was inside my home, and I happened to look outside and see your unsupervised child by my swimming pool.

If you don’t understand how dangerous that is, and that I could be held liable should anything God-forbid happen on my property, there is nothing more to say.

2.) You are so unbelievably rude and entitled. Do not send your child to my home anymore, and if I find him on my property without my permission, I will...

3.) If your son is such a “little fish,” perhaps do some parenting and leave your garage and take him to a swimming pool.

Enroll him in the swim team at the Y. Do something for your child.”

Don’t speak to these people again, and, if possible, contact an attorney for advice on how to best protect yourself.

Do not let any of them, especially the child, on your property again.

stjarnalux − You do, in fact, own this water.

The community was largely in favor of the OP standing their ground and protecting their property. They recognized the importance of setting boundaries when it comes to safety, especially with children around a pool.

Do you think the OP’s response was too harsh, or was it justified given the circumstances? How would you handle a situation with irresponsible neighbors? Share your thoughts below!
