She Smokes in Her Own Backyard. Her Neighbor Filmed Her, Posted It Online, and Hired a Lawyer

It started as something small and ordinary. A cup of coffee in the morning, a cigarette on the back patio, a quiet routine in the privacy of home.

But over a few months, that simple habit turned into a neighborhood conflict that spiraled far beyond complaints about smoke.

Now, there are videos, public posts, shouting over fences, and even a formal letter from an attorney.

And at the center of it all is one question that feels both simple and surprisingly complicated. Is she wrong for continuing to smoke in her own yard?

'AITA for continuing to smoke outside even though my neighbor hired an attorney over it?'

I live in Haslet, Texas, in a single-family neighborhood (quarter-acre lots, fenced yards). My husband and I rent the home.

This started because we occasionally smoke cigarettes outside on our back patio, usually with coffee in the morning or here and there during the day.

We don’t smoke inside the house or in the garage whatsoever.. Our neighbor has been escalating things over the past few months.

It started with complaints, but recently she:

stood on something to look over our fence and recorded me while criticizing me in front of my kids for the example I'm setting, which felt unnecessary and personal

posted about us in the neighborhood Facebook group admittingly telling everyone she recorded me while also identifying which house is ours

screamed over the fence saying she hired an attorney and claimed multiple neighbors are complaining yet most, if not all of the

neighbors who commented sided with us and agreed we have the right to do what we want in the privacy of our own home

We tried to be considerate and even adjusted where we sit outside. At one point we tried going into the garage

with an air filter to avoid bothering anyone, but she still complained, so we stopped doing that and moved the air filter outside.

Now an attorney has sent a formal letter to our landlord claiming we’re creating a “nuisance” and affecting her health, and threatening further action..

For context:. We’re in a detached home (not shared walls). There’s no HOA rule specifically banning smoking.

We're not chain-smoking outside all day. We’ve made efforts to be mindful

I completely understand not liking cigarette smoke, but this has escalated to being recorded, publicly posted about, and now legal threats..

At this point I feel like I’m the one being harassed, not the other way around.. Am I missing something here?

Am I wrong for continuing to smoke outside, or is my neighbor taking this too far?

A Routine That Became a Problem

She and her husband live in a single-family home in a suburban neighborhood, with space between houses, fenced yards, and no shared walls.

They don’t smoke indoors. They don’t chain-smoke outside all day. It’s occasional, mostly tied to moments like morning coffee or a break during the day.

When the neighbor first raised concerns, they didn’t dismiss them.

They adjusted.

They moved where they sat outside. They even tried going into the garage with an air filter to reduce any potential impact. When that still wasn’t enough, they brought the air filter outside instead.

From their perspective, they were making reasonable efforts to be considerate while still living their lives.

But the complaints didn’t stop.

They escalated.

When a Complaint Turns Into Surveillance

At some point, the situation crossed a line.

The neighbor began actively watching them. She stood on something to look over the fence, recorded them in their backyard, and criticized her out loud in front of her children.

Then she took it further.

She posted about them in a neighborhood Facebook group, openly admitting she had recorded them and identifying their house to others. What could have remained a private disagreement turned into a public callout.

And then came the legal angle.

She shouted over the fence that she had hired an attorney. Not long after, a formal letter arrived, accusing them of creating a nuisance and affecting her health.

At that point, the situation no longer felt like a disagreement about smoke.

It felt like harassment.

Where Rights and Boundaries Collide

This kind of conflict sits in a tricky space.

On one hand, cigarette smoke can absolutely travel and affect nearby homes. For people who are sensitive to it, or who have health concerns, it can feel intrusive and frustrating.

On the other hand, this is a detached home with private property, no HOA rules banning smoking, and no shared living spaces.

Legally and socially, those boundaries matter.

Guidance around residential privacy and nuisance disputes, often discussed in frameworks referenced by the American Bar Association, generally centers on reasonableness.

Occasional activities that are legal and typical for a property are rarely considered actionable nuisances unless they are excessive, continuous, or clearly harmful beyond normal expectations.

From what she describes, this doesn’t appear to meet that threshold.

But the emotional side of the conflict doesn’t always follow legal logic.

When Effort Isn’t Enough

What makes this situation frustrating for her is not just the complaint, but the lack of resolution despite her attempts to compromise.

She didn’t ignore the neighbor. She adjusted her behavior. She tried to reduce the impact.

And still, the response intensified.

That creates a sense of imbalance.

Because at some point, being considerate stops feeling like cooperation and starts feeling like surrender. Especially when the other side continues to escalate regardless of what you do.

Most people supported her, focusing on the fact that she is on her own property, following the law, and already making efforts to be considerate.

Neither-Book-3514 − In Texas you have a right to privacy in you backyard. Her recording you could be punishable.

Edit Update: Texas Penal Code § 21.15 — Invasive Visual Recording.

The core protection: fenced-in backyards are recognized as private spaces where people have a reasonable expectation of privacy, even if the area is technically visible from a neighbor’s property.

Worth knowing: starting September 1, 2025, invasive visual recording convictions now automatically trigger s__ offender registration.

Altruistic-Name-1029 − Surely there are laws regarding filming people while they're on their own property without permission,

you need to fight silly pettiness with extreme pettiness & get her arrested

Competitive_Test6697 − I'm having a wood burning pit on all day and BBQs at weekends.

Anyone who comes to my party would be required to hold a cigar.

Many were especially critical of the neighbor’s behavior, particularly the recording and public posting, which crossed from complaint into something more invasive.

FutureBroccoli5566 − Just to add context since a few people are asking, we’re about 40 feet from her fence when we’re outside,

and this is not constant smoking, just here and there during the day. We really have tried to be considerate, which is why this escalation has been so confusing.

PurpleEmotional1401 − NTA. Report her to the Police for harassment and ask Facebook to take down her illegal posts.

The only thing affecting her health is her own paranoid delusion.

Document all pollution sources coming from her property, such as types and numbers of vehicles used, outdoor cooking, indoor cooking smells reaching your property,

chemical spraying of lawn and yard, exhaust fumes from lawn mower and leaf blower and anything else you can think of.

ElectronicBabyy − NTA. The second someone records me in my own yard and starts lecturing me in front of my kids, the "being considerate" phase is over.

She is literally stalking you. Save every screenshot of those Facebook comments.

You are not "creating a nuisance" by having a cigarette with your coffee; she is creating a nuisance by acting like a suburban vigilante.

humble-meercat − *Technically* NTA. I had to rent a house once where the neighbors on both sides smoked.

We had no AC so had to use window fans or leave them open, and the smoke would *always* waft into our place and it was absolutely sickening.

My lungs would begin burning and my eyes stinging and my kids would start coughing and my soul died a little each time I realized one of them was back...

I f__king HATED both of them for being either nose blind or uncaring as to the far reaching noxious odors resulting from their cancerous and ignorant addiction.

I would envision them gasping and wheezing to death for forcing that n__ty disgusting smell into my home and life.

I cursed their trashy asses to seven hells and wished they would just choke on their filthy cigarette butts they left all over the ground. And the worst part is...

It’s 100% a purely for recreation/pleasure, free choice people make. Even if you’re addicted to nicotine there are SO many alternatives and treatments now,

many subsidized by state governments or even 100% free that there’s no excuse to continue such a totally intrusive and obnoxious habit as smoking “traditional” style cigarettes.

Other than you just want to and are in denial or genuinely don’t give a flip how it affects people around you.

However, and much as I despised these people and cursed their very existence, I never said a single word to them.

I just would close the doors and windows, and keep my kids inside because even in the depths of the pure

and utter contempt I had for those arseholes I would never dream of disturbing their peace in their own home.

Even though their invasive stinking cigarette smoke traveled far outside their property and inevitably came into mine and was a horrific poisonous irritant,

I still left them alone because those are the rules.

So if I were her I would absolutely despise you and would 100% be wishing you would drop dead or move away, but you would never know it.

She’s delusional if she thinks a lawyer is going to do anything for her as sadly smoking is still legal.

At the same time, a few voices acknowledged the other side, pointing out how disruptive cigarette smoke can feel when it drifts into nearby homes.

and threatening further action. INFO: have you talked to your landlord, and what is their opinion?

It’s your house. You can smoke in your yard if you want to. She can kick rocks.

Top_Bluejay_5323 − NTA. While not a smoker and would like everyone to stop, I do recognise the limit of my rights.

What are Taxas’ laws on smoking and your rights to privacy in your yard? Send them to her and her attorney along with the legal definition of harassment by herself...

She tried to meet in the middle.

The neighbor kept pushing.

And now, what could have been a minor annoyance has turned into something far more personal and far more stressful.

So maybe the real question isn’t whether she’s wrong for continuing her routine.

It’s how much someone is expected to change their life before it stops being about compromise and starts being about control.
