AITA for getting 3 co-workers fired for making a hot list?

A bunch of people from my department at work went for drinks on Friday after work.

Everyone was having a good time and there were about 20 of us there (from about 30 people in our department).

I go to the bathroom, and as I am about to exit the hall to the bathroom I hear my co-worker say my name from

around the corner of the wall. Perhaps I shouldn't have eavesdropped, but curiosity/suspicion got the best of me and I did.

I overheard a conversation of three guys in my department making a "hot list" (they actually referred to it as that),

which involved ranking every woman in the department from first to last. I was upset and disturbed.

I was quite friendly with 2/3 of the guys, actually.

Yesterday morning I tell HR and they state that they have a zero-tolerance policy for actions like this.

All three men were fired first thing this morning, and now I feel terrible.

I hated the way they were talking about women, but I didn't think they should be fired.

With that said, we work for a large company that I know takes complaints like this seriously,

and would not really miss these 3 guys, so deep down I suppose I knew it was a possibility when I complained.

Nobody knows that I am the person who reported them, and I've overheard people say that the person is a "snitch".

I'm wondering if I should have just confronted them at the bar and told them how it made me feel instead,

but at the time I didn't feel comfortable doing that. I especially feel bad because I had a fairly good relationship with two of the guys. AITA?

INFO 1: It was not a formal work event, but our supervisor organized everyone going out for drinks

INFO 2: A lot of people are insisting that I am upset because I was low on the list.

I tried to avoid making this the focus, but with all the comments I feel like I have to address it.

I was high on the list, and was not offended about my placement;

I was offended about the fact that they were making a list in the first place. I hate that I even have to write this

ETA: wow this is just about the most toxic thing that has ever happened to me.

I came here for judgment on whether I am an a__hole in this situation, and I have gotten numerous personal messages calling me ugly,

a b__ch, fat, a nazi, p__cho, etc. I really think something needs to be done about this sub, although admittedly I'm not sure what,

because I can't believe this is the response for somebody using this sub for its intended purpose.

Until people realize how offensive and damaging treating women as objects is, it will continue to be an issue in the workforce.

Do it in private where nobody eligible for the list will find out about it unless they snoop or eavesdrop

Overhearing and eavesdropping are not the same

If they want to discuss whether Pam or Phyllis has nicer boobs, do it at your own house, not at a party where Phyllis is within earshot

mojo4394 − NTA. This is the type of thing that should go through HR.

If you confronted it directly the reaction could have been retaliation of some sort.

I don't necessarily agree that they should be fired either but that's not your call to make.

because not all practice HR the same way, and all companies have different policies.

You were at a non-work related event, but you said your supervisor set you all up for drinks.

I think we need to understand what constitutes “work related. ” Was this a company function? No.

Did your supervisor set it up, and were you around 20 of your work colleagues and no outsiders?

Yes. Does this mean it’s technically a “work environment” because it’s all work people? You tell me.

Regardless of whether or not this counts as “s__ual harassment” because it’s technically not an outing “related to” your job or workplace,

you always have the right to tell HR if something makes you feel uncomfortable

- specifically if your supervisor set this up and it’s all work people there.

The example I give employees is that if it’s a retirement lunch, and something happens, yes it could be harassment because it’s for work.

If you bump into someone from work at a grocery store who’s hammered, and they say something dumb, not really harassment.

That being said, even though it wasn’t a “work event,” these guys should know better than to talk about this

in front of or around 20 of their work colleagues.

At this point if it made you uncomfortable, and you reported it, it’s HR’s job to do an investigation into it and make the decision.

If it were me, I’d speak to others who were there (did they hear something), interview the three employees,

and compare this with our company policy and previous history.

If this type of behavior has been zero tolerance in the past, then it’s still zero tolerance, and they should be terminated.

If, due to the circumstances, it was determined a non-work event, maybe a note to file or written warning.

Also, I want you to think about any other similar scenario.

If they were comparing people’s races “lightest to darkest” or accents “difficult to understand to easiest”

- do you think any of those people would be offended?

I can guarantee you if your question revolved around them discussing races or ethnicities you’d have a lot more people upset.

S__ and gender are EEO protected classes just like race and ethnicity, so they should be treated the same way.

Overall, it’s not your fault at all if someone else does something that makes you feel uncomfortable. Regardless of who or what it is.

Motto: “I don’t fire you- you fire you. ” ***as I can’t respond to the comments:

Especially in certain states, employment law has a ton of regulations and guidelines.

Some forms of harassment are actually unlawful and companies get sued quite often for not handling those cases appropriately.

To say HR having a zero tolerance policy is lazy is just not true.

Many times HR is just applying the company policies in the situations based on information gathered, or making sure they are abiding by the law.

In fact, company policies are made often times by the corporate office and legal department-

and HR is meant to help enforce them (so they wouldn’t be responsible for the zero-tolerance at all).

If the company has a “zero tolerance policy” and you, as an HR person, don’t enforce it,

you aren’t doing your job and now you’ve put yourself and the company at risk.

Part of why the “you fire you” motto is correct is due to the fact that all proper or “deserved” terminations

(even though i hate using that word) should be based around violation of company policy.

If you break the company policy, that’s not HR making up a reason to term you, that’s HR applying the rules of the company

- rules that you agreed to follow and abide by when you signed the handbook.

In this instance, when OP reported this to HR, they should have looked at the situation from a non-biased, policy based perspective.

Many times there are reasons people get terminated and the small details don’t get shared with the rest of the work population.

Overall HR should be a partner to the business and to the employees- it’s a balance.

We can all sit here and make judgments about whether or not OP’s HR made the right decision,

but the fact of the matter is that none of us have ALL the facts - only they did (if they did their job correctly).

We don’t know what else they found that might have made sense for termination.

If it made OP uncomfortable and she reported it, it was then in the HR department’s hands to handle.

But that's not even the concern - I absolutely would not rank guys at a work event that they are at.

That's where I think the line was crossed So you're fine with talking about coworkers being hot, but no one else can?

How is what they did so much worse just because they ordered their list?

This was after hours, not a work event, going to HR is over the top.

Way to be the a__hole in the group and tattle on coworkers at an after hours hangout.

I wouldn't be surprised if your coworkers already suspect that it was you, you probably give off serious party-pooper vibes.

They are no longer on the clock and under the strict watch of corporate with the need to abide by company policy.

Personally (32F) I would not be offended by these comments whatsoever, but I can appreciate the fact that you were and I support that.

But to take this (objectively) offensive situation to HR when it happened after hours at bar causing them to get fired...YTA.

You could have told them you were offended and ask them to hold off on those conversations until you’re not around

because it makes you uncomfortable. If they continued, it’s on YOU as an adult to walk away.

Not “tell on them”. The immaturity in this situation is mind blowing all around- but you could have handled this so much better.

• You admitted to eavesdropping on a private conversation outside of work

• You felt upset by what they were saying despite the fact that there were no actual manifestations/actions taken

to discriminate between people on their “list”

• You cost 3 people jobs and possibly their families only source of income

• And you DELETED the part of your post admitting that you do THE SAME THING with your girlfriends?? (See comments for post changes).

Yes, you’re a huge a__hole. There is nothing wrong with reporting rule-breaking behavior at work or illegal behavior outside of work,

but you don’t get to police people’s thoughts and freedom of speech.

Also FYI it’s completely normal to think and say that some people are more physically attractive than others.

This shows that they weren’t creepy or trying to solicit you, or anything like that.

If that was the case then I feel like You’d have mentioned that but you didn’t. And if that was the case then they’d easily be TA.

I don’t actually feel like this is as horrible as everyone’s making it out to be.

There’s nothing wrong in discussing who you find attractive, and this was outside of work so it’s not like they were doing this s__t on company time.

If they treated you differently because of this or you confronted them about it then it’d be an easy N T A but that’s not the case.

You’re fully within your rights to be offended by it, hell I’d be offended too.

But I think taking it to HR was a step too far and it makes you the TA in my opinion.

The fact that it was a “work event” is irrelevant because it’s not on corporate time.

It’s a Friday night at the bar for fucks sake and people are shooting the s__t as we all do.

And you know what, you saying that “you’ve never ranked all of them” is a lie.

You mean to tell me that you’ve never said “Guy A is hotter than Guy B but Guy C isn’t bad either”?

Cause let me tell you, that’s ranking people’s attractiveness. YTA.

What it really comes down to is this: If you could go back in time, armed with the knowledge that taking it to HR would result in them

losing their jobs, would you do it again? ETA: 2 things I wanted to add: 1) HR is also the TA for jumping to firing them over this.

Notwithstanding previous similar events which you say to the best of your knowledge hasn’t happened,

firing them was not an appropriate response at all. Writing them up, yes. Suspending them, maybe. But this isn’t a fireable offence to me.

2) I am in no way absolving the three guys of what they did.

I just don’t believe that this is a punishment that’s proportional to the crime.

This was absolutely tasteless and should not happen or be tolerated.

You were an a__hole for reporting them to HR about actions that took place outside of the work environment.

You absolutely should have confronted them personally at the event.

They made you uncomfortable for a night and you cost them their jobs and potential livelihoods.

What happens now when they try to get a new job and the place calls and asks why they were terminated?

Hard to get a new job if your previous one tells people that they were fired due to HR complaints.

You would not have even have to confront them specifically about the list.

All it should have taken is to walk around the corner and say "Hey guys, whatcha talking about? Can I join in the conversation?"

and that should have been enough to get the message through to them. Getting them fired, intentionally or not, was definitely overkill.

because another employee reported that they overheard a conversation at a bar after work. It's not "free" to fire people.

Besides the fact that these people are possibly getting a separation package (depending on the type of work you do)

and unemployment, which is a cost to the company, they also have to hire, and train three new people, which has it's own cost.

So, HR must have thought the situation was worth that expense.

If they thought that, instead of a written warning or something, either more stuff was reported, or you have bad HR reps.

Because if this was the only report, it would have been handled with a meeting with HR at first.
