Co-parenting after a divorce is already difficult enough, but when your ex-husband and his new wife start making decisions about your child’s health without your input, it can feel like a betrayal of trust.

That’s what one mother discovered when she learned her daughter was forced to wear a back brace made out of wood and steel, created by her ex-husband and his wife without any medical justification. Now, her daughter is experiencing pain and numbness, leaving her mother scared and unsure of what to do next.

With a doctor’s appointment already scheduled, the mother is trying to stay calm, but the situation has escalated quickly. She’s concerned about her daughter’s safety and wants to take immediate action. Scroll down to see how she’s planning to address this issue and if there’s anything she can do to protect her child from further harm.

A mother is furious after her ex-husband and his new wife made her daughter wear a harmful wooden and steel back brace

'My ex husband and his new wife made my daughter a back brace out of wood and steel and forced her to wear it?'

My daughter is nine and we share custody by alternating weeks. My daughter says her back hurts now and her arm is tingling.

I have a doctors appointment for her on Monday and in the meantime I am trying to remain calm.

I confronted my ex-husband about it and all her would say was one text message

where he says his new wife didn't like how my daughter slouched at the dinner table.

They aren't doctors and there is nothing wrong with her that she needs a brace.

I f__king want to k__l both of them. Is there a way I can get a quick court date or see a judge because I don't want her going back...

When we divorced it took a long time to figure out custody.

Edit: Sorry the location is the state of Florida. I'm so mad I'm having a hard time focusing.

OP later provided an update:

UPDATE: Firstly I would like to thank everyone for all the support in my first post and all the supportive PM's I received.

It was really overwhelming (in a good way). A few people asked for an update so here it is.

So a lot has happened since I first posted. I called in to work while I was trying to get all this sorted.

One of my co-workers has a cousin who is a lawyer and she knew someone who was able to help me and file the paperwork.

My husband played dumb in court but his visits got reduced to supervised and he was ordered to take a parenting class.

My daughter went to physiotherapy. Eventually the court reinstated his visitation when he swore he had learned his lesson

and was sorry and with his otherwise clean record the court agreed. I was against it but the court ruled against me.

I gave my daughter her own cell phone so she could call me whenever she needed to. On her second visit it happened again.

This time the brace had steel and fabric instead of wood and they took her phone too.

The next night she left when they weren't looking and went up the street to a neighbor who is a police officer.

The neighbor called paramedics and her co-workers. They had to cut the brace off my daughter.

My husband and his wife were arrested. They got out quickly but they have been charged and their infant is with CPS.

My ex lost visitation and custody and I'm working on making it permanent.

Unfortunately my daughter's shoulder was dislocated from the brace. It set back her rehab and part of her arm is still numb and tingling.

She needed surgery and is still recovering. She always played sports (especially at school)

and did dance but the doctor thinks she won't ever be able to lift her arm all the way up again.

I hate my ex and he'll see her again over my f**king dead body.

Right now I'm focusing on my daughter while my lawyer takes care of things. That's my update.

As a parent, when you feel your child’s safety is compromised, your fear and protective instincts become urgent. In this case, the OP believes her daughter’s health and well‑being were put at risk by her ex‑husband and his new wife, forcing her to wear a back brace without medical justification.

The daughter’s complaints of pain and tingling, combined with a suspect device and non‑medical intervention, trigger every parent’s alarm.

Emotionally, the situation is deeply destabilising. The OP is caught between the trauma of believing her child is being harmed and the legal complexity of custody arrangements. She sees the back brace as an act of neglect or misuse of control; her daughter’s distress confirms her feeling of violation.

At the same time, her ex‑husband exercises his parenting time and physical access, leaving the OP powerless in those moments. This imbalance creates intense emotional strain, not only over the child’s health but over the broken dynamic of trust and shared responsibility.

The story also reveals how custody systems can sometimes lag behind urgent protective needs. Many parents assume custody schedules and exchanges are safe by design, but when a parent, new spouse, or caretaker intervenes in a child’s physical health without consent, the situation may escalate into a legal emergency.

The OP’s instinct to seek immediate court action is not just emotional; it can be legally supported. Florida law recognises “emergency custody” or “emergency child pickup orders” when a child faces imminent danger, neglect, or abuse. (traviswalkerlaw.com)

Expert legal insight confirms this pathway. One attorney explains: in Florida, you can file an emergency custody order ex parte (without prior notice to the other parent) when there is credible evidence that the child is in immediate harm. Documentation such as medical records, police reports, or witness testimony strengthens your case.

Also, there is a Florida Supreme Court–approved form (12.941(d)) you can use for a Child Pick‑Up Order in emergencies.

This directly applies to OP’s situation. The child has reported physical symptoms (back pain, tingling), and the brace was forced without medical supervision.

Combined with her ex‑husband’s refusal to explain and his wife’s unconventional intervention, there is a basis for seeking expedited legal intervention.

Importantly, the “best interests of the child” standard in Florida (see Florida Statute § 61.13) means that if the court finds actual or imminent harm, they can grant temporary orders to protect the child.

So, the OP is on legally solid ground to pursue emergency custody if she documents the incident. She should gather medical appointments, statements from the child, any messages/texts about the brace, and file an “Emergency Verified Motion for Child Pick‑Up Order” or similar.

Seeking counsel from a family law attorney in the relevant Florida circuit is highly recommended to move quickly and protect her daughter’s safety.

Here’s what Redditors had to say:

This group suggested taking immediate legal action

butterfliesinhereyes − There's something called an ex parte motion that you could file.

They are emergency motions that get you before a judge the same day you file.

Your local family court should have a form for it. Whether your facts merit such a filing is completely up to you.

ruralife − Report this to child protective services. They may take this far more seriously than the police.

King_Posner − File an emergency motion through your attorney.

These commenters stressed the importance of consulting a family law attorney and taking steps to restrict unsupervised visits

DragonMadre − This is child abuse - forcing a child to wear some sort of wooden harness.

Call CPS, report your husband and his new wife, who by the way, should be told to NEVER touch your daughter.

Call you attorney and tell him what happened and move to restrict all unsupervised visits.

Who knows what else these people will do in the future.

mathemagicat − You need (like, need need) a family law attorney. Go directly to your phone and call one first thing in the morning.

Do not file any motions; do not call anyone else; do not take any other Reddit advice; do not pass Go; do not collect $200.

Specifically: Do not speak to your ex-husband or his wife again until this issue is resolved.

All contact should be through your lawyer. If you receive any more communications, forward them to your lawyer.

Do not call CPS unless advised to do so by your lawyer. Do not post any more information on social media.

Ask your lawyer what to do with the post(s) you've already made.

Do go to the doctor's appointment. Do get everything s/he tells you in writing.

Do not give this information to anyone other than your lawyer. TL;DR: Lawyer up.

locks_are_paranoid − Call CPS immediately. Also, please update us with what happens.

This group expressed outrage at the situation and sympathy for the child

bebopblues − So much WTF. What other f**ked up s__t that they do? This can't be the only thing.

SenatorMeathooks − Your ex and his spouse are huge sacks of s__t and I'm glad they're never get visitation

but I feel so sorry for your daughter. I'm glad she's safe now.

PooieCK − One of those few posts which comes along every 6-12 months which makes you literally physically ill and nauseous to read.

Props for having such a cool and smooth head about this disgusting situation. Stay strong.

These commenters added a touch of humor

Knockemm − Thank you for the update. I am so sorry this happened to your daughter.

I am glad that ultimately they were arrested and charged and that the infant is in a safer place,

but I can't imagine what you must be feeling. Take care.

FortuneHasFaded − This. Is. So Florida.

[Reddit User] − I just read the update. Holy hell I feel so much for you and your daughter. It's sad he ever got the rights back in the first place,...

DBREEZE223 − wish her the best

ixora7 − How thick can someone get!?? Holy christ.

What would you do in this situation? Should the mother take legal action against her ex-husband and his wife? Share your thoughts below!
