New Dad Asks the Court for Less Time With His Baby Son, Leaving the Mother Completely Heartbroken

Custody battles are difficult enough when both parents are fighting to spend as much time as possible with their children. It can feel even more heartbreaking when the situation goes in the opposite direction, especially when a parent willingly gives up time they could have had.

The OP recently had a baby boy, but her husband filed for divorce earlier this year. Under the law in their state, parents generally begin with an equal parenting arrangement unless there is a serious reason to change it. Everyone expected that to happen once she finished breastfeeding.

Instead, her husband asked the court for significantly less time with their son and even said he would rather pay child support than share custody. What made the situation harder was that his decision appeared to extend far beyond the baby stage. Scroll down to see why the OP is struggling with his choice.

'My soon to be ex-husband asked the court to give him less custody and visitation with our son'

(Background: in my state there is a law which gives parents a 50-50 split in terms of parenting time with their children.

If there is something like d__g use, n__lect or abuse the other parent can bring this up to not have the 50-50 split,

but without these things parents start with that when they are not together.

It's an actual law and according to my lawyer one of the most popular passed in recent years)

I have a 1 month old son. His father filed for divorce earlier this year.

My lawyer and me expected that custody would be 50-50 split, legal and physical in the next few months once I am done breastfeeding.

This is what the court expected. My husband is aware of this law and he has a lawyer.

He rejected the 50-50 split time and asked for every other weekend only (excluding holidays) with me having physical and legal custody.

Even after the court asked his lawyer to explain the law to him again he said he was sure.

By his own submission he does not want to be the "primary" parent or make any decisions.

and is fine with me having legal and physical custody while he gets a "little" visitation.

If we split custody there would be no child support because our incomes are fairly equal but he said he would rather pay me to be the primary parent.

He also clarified that this isn't just for when our son is a small baby.

The court thought he was concerned about our son being away from me when

he was so little but my husband said 50-50 is too much time no ~~chatter~~ matter our son's age.

He also told the court he doesn't want any time with our son in the next few months while I am breastfeeding

(because he would be entitled to visitation then as well) and can start the every other weekend when I'm done.

The court can't make him spend time with our son so his request was granted. Mostly I'm just sad for my son that his father specifically asked for less time...

UPDATE: My ex-husband left me for another woman. I was pregnant at the time.

My divorce lawyer told me that in our state there is a law which gives parents a 50-50 split in terms of parenting time with their children.

If there is something like drug use, neglect or abuse the other parent can bring this up to not have the 50-50 split,

but without these things parents start with that if they are not together.

It was in my other post here [which I completely forgot about until now] how heartbroken I was.

My son was a month old back then. He's turning four next week. My ex-husband has only met my son four times.

The woman my ex-husband left me for went back to her husband so my ex ignoring my son had nothing to do with her.

I'm grateful that my son doesn't remember his father because it would rip me apart if he was old enough to understand that his father doesn't want him.

I know the day is coming when my son realizes his father is a deadbeat and I'm dreading it because of how much it will hurt my son.

I didn't remember posting here before but I was going to post to vent because I found out my ex-husband moved to another state.

He moved 2500 miles away and didn't tell me. I suppose I shouldn't be surprised given he doesn't care about my son. But I'm still furious.

I'm angry, I'm heartbroken and I hate him. He destroyed me when he left and I tried to put it aside for the sake of my son but my ex...

I'm still seeing a therapist over it. I can handle being heartbroken but I don't want that for my son.

I'm already sick thinking of the day my son realizes his father doesn't want him. MY EX MOVED 2500 MILES AWAY AND I HATE HIM. I hate him so much.

Also to all those who commented on my last post or sent me messages saying I babytrapped my ex-husband against his will or that I'm a gold digger:

My son was conceived with IUI. I didn't trick my ex-husband into anything.

He wanted kids, was fully on board with the IUI and he was also researching adoption in case we were not successful.

There was no babytrapping here. I work and wasn't "leeching" off him.

If we had split 50-50 custody neither of us would have paid the other child support.

My ex-husband has never paid any of his court ordered child support and I had a job for our entire marriage.

Few things can hurt a parent more deeply than watching another parent voluntarily step away from their child. Divorce already creates uncertainty, but hearing a father explicitly ask for less involvement can make the future feel painfully different from what the other parent imagined for their child.

The OP’s sadness is understandable because this isn’t simply a custody dispute about schedules. Her son’s father was given the opportunity to pursue equal parenting time and instead specifically requested every other weekend, no holidays, limited decision-making, and no visitation during the breastfeeding period.

What seems to weigh on her most is the intentional nature of that choice. She isn’t describing a father being prevented from seeing his child. She is describing a father who apparently does not want the responsibilities associated with being the primary or equally involved parent.

There is another perspective worth considering, however. Adults can sometimes make decisions about parenting based on their own perceived limitations, emotional capacity, lifestyle, or willingness to assume responsibility.

That does not necessarily mean the child is unloved. A parent who recognizes that they cannot or will not provide equal day-to-day involvement may be making a painful but honest assessment. The problem is that children can still experience the absence, regardless of the parent’s reasoning.

Developmental psychologist Edward Tronick’s work on parent-child relationships helps explain why consistent interaction matters. His research on early relationships has emphasized that infants develop through repeated cycles of interaction, connection, disruption, and repair with caregivers.

The Harvard Center on the Developing Child describes this responsive back-and-forth between children and caregivers as an important foundation for early development.

This does not mean every family must follow a particular custody schedule, nor does it establish that equal custody is automatically best. It does illustrate why a parent’s consistent presence can become meaningful through ordinary repeated experiences rather than occasional dramatic moments.

That distinction matters for the OP because she cannot manufacture a relationship between her son and his father by forcing a schedule the father does not want.

Courts can determine legal rights and responsibilities, but they cannot manufacture parental motivation. Trying to compensate for his absence by becoming both parents may also leave her carrying an emotional burden that was never hers alone.

The healthiest interpretation may therefore be to separate the father’s choices from the child’s worth. Her son did not cause this decision, and his father’s limited involvement should never become a story about the child being unwanted or unlovable.

As he grows older, what may matter most is that the adults around him provide stability and avoid making him responsible for understanding his father’s choices.

The OP has every right to grieve the father-child relationship she hoped her son would have. She does not need to pretend the situation doesn’t hurt. At the same time, her son’s childhood does not have to be defined entirely by what his father refuses to do. A child can still grow up surrounded by dependable adults, affection, consistency, and opportunities to feel secure.

Perhaps the hardest truth here is also the most freeing one: she cannot make his father want to be more involved, but she can make sure her son never mistakes his father’s absence for a reflection of his own value.

TylerNadel − Happened to me as well. Same in our state with the laws and when me and my son(now 16) father split

(when he was 2) he didn't want anything to do with him. No visitation, no contact, just nothing.

He didn't pay child support for 12 years either. These men are just loser dead beats. It's hard but it's for the best.

Let him just fade out of your lives and you love that child with every fiber of your being.

My guess is, even once his visitation starts, he will bring the child back early and eventually cease all visitation.

Document ALL of that. He clearly does not want to be a father. Take that as a fact and move on.
